9:15 – social work and the law

This session is presented by our Social Work staff and focusses on the work of the Slater and Gordon Social Work Service to our clients. The service was established in May 2009 and the structure, role and provision of the social work service within a private law firm is presented. There is also a focus on the acute and chronic psychosocial impact of serious injury, debility and illness on clients and their families within the compensation context based on the team’s practice experience.

9:45 – Privacy and Documentation (combined and condensed program)

This session defines Privacy and Confidentiality. It explains patients’ rights and your obligations: the duty of confidentiality; exceptions to this duty; and, when it is your duty to breach confidentiality. We also explore how to address the conflicts in confidentiality. This session provides an overview of best practice for documenting clinical notes and writing reports for court: content, access, storage and litigation. Subpoenas and your obligations are explained. Attending court, giving evidence and your conduct in court are explored. This session will assist you to minimise your legal risks and survive the court process.

11:30 – legal issues of Capacity

Capacity is defined from legal and medical perspectives and how it relates to informed consent for adults and minors. An explanation of the different powers of attorney and how they apply is provided. The role of the Guardianship Division of the NSW Civil and Administrative Tribunal is discussed. Advanced care planning and end of life decisions are also explored
